A client of ours who was charged with one count of Intimidation, in addition to having an AVO filed against him, has walked away from court with his charge completely dismissed by a Local Court Magistrate after a successful Hearing on the matter.
Our client entered a plea of ‘not guilty’ to a charge of Intimidation. At Hearing, due to the case put forward by Brady and Associates, Her Honour remarked that it was ‘impossible to know where the offence occurred, if it occurred, and what was said’ due to the inconsistencies of each witness.
Her Honour ruled that the offence was not proven beyond a reasonable doubt, and as such the charge was dismissed.
